Liability Waiver & Release

1. Acknowledgment of Risks

I acknowledge that participating in FindSquad searches involves inherent risks, including but not limited to:

• Physical injuries from walking, running, or traversing terrain
• Weather-related hazards (heat, cold, rain, lightning)
• Encounters with wildlife or domestic animals
• Traffic accidents when searching near roadways
• Trespassing or property-access issues
• Getting lost or separated from the search group
• Other unforeseen hazards of outdoor activity

2. Voluntary Participation

My participation is entirely voluntary. I am not required to participate and may leave any search at any time.

3. Assumption of Risk

To the fullest extent permitted by law, I voluntarily assume all risks associated with participating in search activities, both known and unknown. I understand that FindSquad, Inc. does not supervise searches, does not vet or employ other participants, and does not control the conditions in which searches take place.

4. Release of Liability

To the fullest extent permitted by law, I release, waive, and discharge FindSquad, Inc. and its officers, employees, and agents (collectively, the "Released Parties") from claims for loss, damage, or injury (including death) arising out of my participation in search activities and caused by ordinary negligence.

This release does not apply to, and I do not waive, any liability for gross negligence, recklessness, willful or intentional misconduct, or any liability that cannot be waived or limited under applicable law. If any part of this release is held unenforceable, the remainder stays in effect (see Section 12).

5. Indemnification

To the extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims, losses, or costs arising from my own conduct during search activities, including reasonable attorneys' fees. This does not require me to indemnify a Released Party for that party's own gross negligence or willful misconduct.

6. Medical Treatment

In an emergency, I authorize the Released Parties to seek emergency medical treatment on my behalf if I am unable to do so. I am responsible for the costs of any such treatment.

7. Personal Responsibility

I understand that I am responsible for:

• My own safety and well-being during searches
• Following all applicable laws and regulations
• Obtaining permission before entering private property
• Using common sense and exercising caution
• Bringing appropriate supplies (water, phone, first aid)
• Informing someone of my search participation

8. No Insurance Provided

FindSquad, Inc. does not provide health, accident, or liability insurance for users. I am responsible for maintaining my own insurance coverage.

9. Photo and Media Release (Opt-In)

FindSquad will not use photographs, video, or other media of you for promotional purposes unless you affirmatively opt in. We may ask for your permission separately; you can grant or decline it, and you can withdraw a previously granted permission at any time by contacting us. Media you upload into a search is used only to operate that search.

10. Property Damage

I am responsible for any damage I cause to property during search activities. FindSquad, Inc. is not liable for property damage caused by users.

11. Lost or Stolen Property

FindSquad, Inc. is not responsible for personal property that is lost, stolen, or damaged during search activities.

12. Severability

If any portion of this waiver is found void or unenforceable, that portion will be limited or removed to the minimum extent necessary, and the remaining portions will stay in full force and effect.

13. Governing Law

This waiver is governed by the laws of the State of Arizona. Any legal action must be brought in the state or federal courts located in Arizona.

14. Acknowledgment of Understanding

BY USING FINDSQUAD FOR SEARCH ACTIVITIES, I ACKNOWLEDGE THAT:

• I have read this entire waiver
• I understand its contents
• I understand it is a release of liability, subject to the carve-outs in Section 4
• I am voluntarily agreeing to its terms
• I am at least 18 years old, or I am 13–17 and my parent or legal guardian has consented on my behalf
